Service Agreement

1- Parties

1.1: This agreement is deemed to have been signed between Hostixo İnternet Bil. Yaz. Hiz. Ticaret ve Sanayi Limited Şirketi (hereinafter referred to as Hostixo.com), which provides the services specified in the services section, and the person/institution (hereinafter referred to as Customer) specified with the details in the New customer registration section, regarding the use of the website operating at https://www.hostixo.com (and its sub-sites) belonging to Hostixo.com (hereinafter referred to as Site) and the services to be purchased through this site, under the terms and conditions specified below.

1.2: The parties declare, accept, and undertake the accuracy of the information written in this agreement.

2- Subject

2.1: This agreement will regulate the sections that the customer is allowed to do and not to do in accordance with the information given in the registration process, in their transactions on the site, in their orders, in the messages they send, and the fees that the customer will pay to Hostixo.com in return for the services they will receive in accordance with their preferences in their orders. These service and transaction descriptions are as follows.

2.2: Membership information is the information entered by the customer during membership. Since this information will be based on the transactions made, it is assumed that the customer and the member enter this information completely, completely, and correctly.

3- Responsibilities

3.1: Hostixo.com will provide the services transmitted as an order upon the customer's request. With the order acceptance message, Hostixo.com will accept that it has collected the relevant fee and undertake to provide the service specified in the subject order.

3.2: The payment method, VAT differences will be specified with the total amount to be extracted during the order, and the fees that the customer must pay according to their monthly or annual payment preferences will be notified by Hostixo.com.

3.3: After the order acceptance and approval of the transactions, Hostixo.com will transmit the access information and passwords regarding the service in the customer order detail to the customer, and the service will have started. The responsibility of the relevant accounts and passwords belongs to the customer, and the customer will be responsible for any damage and loss that may arise from these issues.

3.4: The customer undertakes to comply with the statements and warnings received by Hostixo.com within the scope of the service received. The customer declares, accepts, and undertakes to comply with any warning or notification published by Hostixo.com while benefiting from the hosting account. The customer cannot distribute or sell the services provided to him/her free of charge and unlimitedly in the hosting service he/she has received to third parties, again for a fee or free of charge and/or limited or unlimited.

3.5: The customer undertakes not to access files or programs that do not have the right to access by using the software and programs he/she has within the scope of the service, not to create any problems due to such a problem, and to cover the damage in problems and problems that may occur.

3.6: The customer accepts and undertakes that the taxes, fees, and similar obligations in force during the use of the domain name, hosting, or services received or that will come into force during the contract period belong to him/her and will meet them.

3.7: The customer accepts and undertakes that he/she is responsible for all files, documents, and programs hosted within the service, all transactions that he/she will use and benefit from with the website and e-mail services, and that he/she will bear all legal and criminal liability that may arise from the illegality of the said data, information, and statements. No fault can be transmitted to Hostixo.com for problems that may arise in this regard.

3.8: Hostixo.com does not review, verify, endorse pages before they are posted, or take any responsibility for pages made by the user. Hostixo.com may terminate user accounts because they violate these outlines or for any other reason or because Hostixo.com believes it is harmful to its own or any of its users' business. Hostixo.com has the right to delete illegal acts and actions without notifying the customer from the moment it learns about them.

3.9: Hostixo.com cannot be held responsible for any material or moral damages that may arise from the incorrect use of customer data contained in the service it provides, data content, and all data used by e-mail. The backup and storage obligations of these data belong to the customer. Hostixo.com will subject all customer data to regular backup and maintenance. However, Hostixo.com is not responsible for errors, damages, and losses that may occur due to interruption or data loss that may occur in Hostixo.com services. Backing up data is the customer's responsibility unless otherwise stated in the contract text.

3.10: Hostixo.com will carry out domain name registration transactions ordered by the customer and paid for without any problems. The owner of the domain name registered and paid for with the registration request accepted with the order is the customer. Hostixo.com will be able to perform transactions on the domain name in line with the customer's demands in this regard. It will make an arrangement, change, and transfer requests on the domain name by the customer as soon as possible.

4- Duration

4.1: This agreement begins with the transmission of order and payment transactions to Hostixo.com from the internet environment, and the specified rights and obligations of the parties begin.

4.2: The contract period is as much as the payment period chosen by the customer during the order for the relevant service.

4.3: If the parties have not warned that the contract will end at the end of the period up to 10 business days before the end of the contract, the contract extends for the duration of the previous contract with the same terms and conditions. (Changes occurring in fee matters are reserved.)

5- Fee

5.1: The fee to be paid in return for the services specified in this agreement is the amount specified during the order process. VAT is calculated by including it in the specified fees later, and the collection is realized by showing it to the customer.

5.2: Hostixo.com reserves the right to make forward-looking changes on prices and tariffs without prior notice. The customer accepts, declares, and undertakes the changes that may occur in advance regarding these changes.

5.3: If the fee is in foreign currency, it is paid by converting it into Turkish Lira over the effective selling rate at the invoice date.

5.4: The customer is obliged to pay the fee from the credit card account if there is a credit card payment order during the order process until the end of the 5th business day from the invoice issuance date, or to the bank account numbers specified in the customer communication address or to Hostixo.com by hand if there is no credit card payment order.

5.5: In case of delayed payment, Hostixo.com reserves the right to issue an exchange rate difference invoice.

5.6: Hostixo.com reserves the right to close and open the relevant service until the customer completes the payment process.

5.7 : As stated during the order, no refunds are made for domain/domain name, SSL certificates, monthly hosting, reseller hosting, and server services (co-location, dedicated, vps virtual servers) transactions.

6- Suspension

6.1: Hostixo.com reserves the right to stop all services provided to the customer, all e-mail, web, ftp accounts due to payment problems, provision problems in customers with credit card payment orders, or articles related to terms and obligations.

6.2: During the continuation of this situation, e-mail, web, ftp access cannot be made on behalf of the customer, and incoming e-mails are rejected by blocking e-mail accounts.

6.3: The maximum CPU and RAM usage rate per site on the server is 10% for individual hosting, 12% for reseller hosting, and 15% for corporate hosting. User accounts exceeding the specified limits are suspended after the first warning.

6.4 : It is forbidden to keep content contrary to both copyrights and T.C. laws on our servers. This content includes Hack, Crack, Warez, Adult, and MP3 content.

6.5: The security of all software on the server belongs to our customers. My company is in no way responsible for any issue that may arise from your software or management side.

7- Termination

7.1: If the customer does not fulfill his/her responsibilities and commitments by acting contrary to any article of this agreement or if it is determined that the information declared on the front of this agreement is not correct, if the suspension of the agreement mentioned above continues for more than 7 days, Hostixo.com has the right to terminate the agreement unilaterally without any warning or notice.

7.2: After the termination to occur in this way, the customer; declares, accepts, and undertakes that he/she cannot request the last contract fee he/she has paid back regardless of the remaining period, and to pay 5 times the commercial penal compensation of the equivalent contract price in force at the date of termination.

7.3: The customer has the right to terminate this agreement at the end of the period, provided that he/she gives written warning 10 days before the normal period of the agreement ends without showing any reason.

7.4: In case of termination by the customer before the end of the contract period, he/she declares, accepts, and undertakes to pay 1/2 of the fees to be paid until the end of the contract in advance and in cash.

8- Contact and Information Addresses

8.1: The parties have accepted, declared, and undertaken the postal addresses specified in the order address as the legal residence for all kinds of notifications arising from the subject contract.

8.2: Any notification made to these addresses will be deemed to have been notified even if it does not reach the parties. Unless changes to these addresses are notified to the other party in writing, the old addresses will be valid.

8.3: Hostixo.com may send messages, information, letters, warnings, payment notifications, account movement charts, account statements to the e-mail address allocated to the customer within the contract period. The customer declares, accepts, and undertakes that he/she cannot claim that the said electronic messages were not received or did not reach him/her, and that the said messages will be deemed to be legally notified 1 day after the date they were sent.

9- Default in Payment of Fee

9.1: If the customer does not make the payment within 7 days following the application date for the services received, he/she is deemed to be in default. In this case, Hostixo.com may issue an exchange rate difference invoice or demand 15% monthly delay interest from the invoice date if it wishes. The customer declares and accepts to pay this delay interest and the exchange rate difference invoice.

9.2: The customer declares, accepts, and undertakes to pay 15% monthly delay interest, 50% of the balance debt amount as a penal clause, 10% Attorney's Fee, and all other legal expenses in case Hostixo.com files a lawsuit or enforcement proceeding for any receivables arising from this agreement.

9.3: The customer declares, accepts, and undertakes that Hostixo.com is authorized to obtain a Precautionary Attachment and Precautionary Measure decision without guarantee in case it applies to legal authorities for Precautionary Attachment and Precautionary Measure for the collection of its receivables arising from this agreement, but even so, when guarantee is requested by the Courts, the commission and all kinds of fees arising from the letters of guarantee to be obtained from the Banks will be paid by them and they will not object to these issues.

10- Authorized Courts and Enforcement Offices

10.1: This agreement consists of 10 articles, subtitles, and APPENDIX-1, and has been read and understood by the parties and accepted in the electronic environment or signed. Hostixo.com may add, remove, or make changes to the articles if it deems necessary. The customer declares and undertakes that he/she accepts these changes in advance.

10.2: Niğde Courts and Enforcement Offices are authorized to resolve any disputes that may arise during the implementation of this agreement.

APPENDIX-1

Account Settings / E-mail Address

Your account will be activated after the payment constitutes collected. Whether your email address in your account is valid or not is entirely up to your preference. If there is any complaint or if we need to contact you, we will contact you using your primary e-mail address in your customer panel. For this reason, it is in your best interest to enter your e-mail address correctly and check it regularly. Entering incorrect contact information may cause bad consequences such as closing your account.

Migration

Our transfer team will make every effort during your move to Hostixo.com. The transfer process is only a free service offered for the convenience of users. Hostixo.com cannot guarantee whether the migration process is possible or will be completed within any time. Each hosting company is arranged differently, and some hosting platforms store data incompatibly or privately. This makes the migration process inappropriate or quite difficult. We will do our best, but in some cases we would like to state that we cannot help you with your migration process. Currently, we only offer cPanel to cPanel migration service. The number of sites that can be moved for free is 10. If the number of sites to be moved is more than 10, you can have our team move them by paying the moving fee determined by our Hostixo sales team per site upon your request.

The free migration service only covers a period of 30 days from the start date of your membership. It does not cover the transfer of addon domains. Hostixo does not guarantee that there will be a 100% trouble-free guarantee regarding migration or that it will offer software support.

Hostixo.com uses a central dns structure. For this reason, when you move from any of our servers to another server, you must delete the account you do not use, because a website does not work on two different servers. If you do not make the necessary intervention and delete the account you do not use, our technical team may delete the hosting account on the server where your website is not active on your behalf during the checks.

Content

All services provided by Hostixo.com must be used for legal purposes. Hostixo.com accepts the laws of the Republic of Turkey. No written, audio or visual content or material presented on Hostixo.com servers can be contrary to the laws of the Republic of Turkey. Otherwise, all material and moral responsibilities born/to be born belong to the customer. Service provider Hostixo.com is not liable.

Customers guarantee that they will not put Hostixo.com in a situation where it will be harmed due to the services it provides.

It is forbidden to violate trademarks or copyrights in our services. This covers unauthorized music copying, books, photos, or any transaction containing copyright. Selling counterfeit versions of any trademark services results in immediate deletion of your account. When any account violating these rules or violating copyrights is detected, the account is frozen or completely deleted. If you think your copyrights or trademark rights are being violated, you can send the necessary information to destek@hostixo.com as an e-mail. If the issue is a license, we may need necessary documentation.

It is forbidden to use shared hosting service as a backup or storage, “Only 1 cPanel backup compressed (.tar.gz, .rar, .zip etc.) format can be found in FTP. Please do not take backups of your backups.

    • Investment sites (FOREX, E-gold Exchange, Second Life/Linden Exchange, Ponzi, MLM / Pyramid Scheme)
    • Sale of any material without having the legal distribution right
    • Prime Bank Programs
    • Lottery game sites
    • MUD/RPG or PPBGs
    • Hateful / racist / harassing sites
    • Hacker-oriented sites / archives / programs
    • Sites organizing illegal activities
    • Forums/web pages containing illegal, copyrighted links (warez)
    • Metin2, Knight Online style game sites
    • Applications for gaining followers from social media like Twitter, Facebook
    • Mailer Pro etc.

Hostixo.com services, all related equipment, networks, and network devices are authorized only for customer use. Hostixo.com may monitor the services it offers for legal issues when necessary, to check whether the customer is making authorized use, for system management, to prevent unauthorized use, to check security procedures, and for operational security. During this monitoring process, information may be examined, recorded, or copied. By using Hostixo.com services, you accept this monitoring process.

Hostixo.com reserves the right to refuse the service used. Intervening in the use of the service offered is entirely under the control of Hostixo.com. For example, sites containing threats or violating copyrights may be deleted from our servers without warning. In these and similar cases, our Complaint department will contact you (via phone or e-mail), if no result is obtained within 48 hours, your account may be frozen or deleted.

If you have doubts about whether your site has acceptable content, you can send an e-mail to destek@hostixo.com and get detailed information without hesitation, we will be happy to help you!

For Reseller users: Accounts are frozen when similar conditions occur and a message is sent to the reseller owner about the deletion of the account. In case of multiple similar violations, Hostixo.com may freeze or cancel your reseller account.

For direct customers: Your account is deleted from our servers without sending any messages.

When the situation stated above occurs, Hostixo.com reports the necessary information to the competent authorities.

It is entirely the customer's responsibility to ensure that the scripts/programs used in your account are secure and file permissions are set correctly. Users are responsible for all changes occurring in their accounts. This involves the username and password you use when logging into the system. For your security, you should be careful that your password is difficult. If you use a weak password (like 123456), your account may be frozen until you agree to use a strong password. If it is detected that your password is weak during the account check process, we will send you a message to change/update your password.

We do not tolerate unsolicited e-mails. The accounts of users who spam will be deleted without sending any warning message.

Customers using shared hosting service can review the Mail Policy.

Spammers cannot be hosted on Hostixo.com servers. This ban does not only cover fax, instant messaging or Usenet/Newsgroup categories.

Hostixo.com reserves the right to make changes to any web page, account, database, or other components when deemed necessary.

In all our shared servers (Individual hosting, Corporate Hosting, SEO Hosting, Reseller Hosting etc.), the php mail function is closed for security reasons. Hostixo.com only allows secure e-mail sending via SMTP protocol.

Payment Information

You are obliged to pay for any service you receive from Hostixo.com. Hostixo.com guarantees the continuity of the service until the end of the provision process of the paid service. You are obliged to make your payment as long as you do not warn us to cancel the use of the service you ordered or as long as you use the entire service we provide to you.

You can send an e-mail to destek@hostixo.com for detailed information about service cancellations.

As a Hostixo.com customer, it is entirely your responsibility to enter your customer information correctly and make your payments on time. Hostixo.com guarantees to keep your data for 7 days from the invoice creation date. If you do not pay your invoice for 7 days, your account may be frozen or deleted. If there will be a delay in your payments, we would like you to contact us and ensure that we are informed about this issue so that your account is not frozen or deleted.

Hostixo.com reserves the right to change the payment amount and service fee at any time.

Backup and Data Loss

Taking backups is entirely the customer's responsibility. Our backup service is just a free security service provided by us. Hostixo.com is not responsible for any data/file loss you have experienced. With this agreement, you accept that you have all rights on your files.

Cancellations and Refunds

Hostixo.com reserves the right to close and freeze user accounts at any time without sending any warning.

Customers can request account cancellation at any time. For detailed information about account cancellation, you can send an e-mail to destek@hostixo.com or reach us via +90 388 606 03 67 phone number. Hostixo.com may refund you within the scope of cancellation and refund conditions in case of any dissatisfaction.

Resource Usage

Users cannot do the following:

* Consumption of system resources by 20% or more for more than 90 seconds

* Use of stand-alone server-side applications (For example, hosting IRCD.)

* Use of any type of web spider or bots that provide indexing of sites is prohibited in shared hosting service. (For example Google Cash / AdSpy)

* Using any software similar to Internet Relay Chat (IRC) network

* It is forbidden to run any bit torrent application. You may be doing legal distribution for torrent, but you cannot host it on shared hosting service.

* You cannot be involved in any file sharing/peer-to-peer,

* You cannot run any game server. (like half life, counter strike, battlefield1942)

* Cron entries can be set minimum every 30 minutes for individual hosting service, 20 for reseller accounts, and 10 for corporate hosting accounts. Cron entries made outside the specified limits may be deleted without notice.

* When including any local file using PHP's include function, you should use include("include.php") instead of "http://www.yourdomain.com/include.php".

* Maximum database size is limited to 500MB for individual hosting service, 750MB for reseller hosting service, and 1000MB for corporate hosting service.

* CPU limit is determined as 10% for individual web hosting service, 15% for corporate web hosting, and 12% for reseller hosting service. Customers cannot use continuously at the specified rate.

Resource Usage – INODEs

Any user using shared hosting service (including reseller hosting) using more than 100,000 inodes will receive a warning. If no precautions are taken despite the warning, the account is frozen. The accounts of users exceeding the 250,000 inode limit will be legally deleted from our backup system to fix the average usage. Each file (web page, image, e-mail, etc.) uses 1 inode.

We do not like to freeze the accounts of users who do not exceed the usage limit much; however, we examine and/or freeze the accounts of users who frequently create and delete large files, create hundreds of thousands of files or cause damage to the system.

Backup Limit

Daily and weekly backups of users using more than 2 GB disk space or 250,000 inodes limit in shared hosting service are not taken by us. Hostixo.com takes daily, weekly, and monthly backups so that all data is not lost when any hardware problem occurs. These backups are not for the use of users, but so that data is not lost when any technical problem occurs.

Traffic Usage

You can use the traffic area allocated to you. Its quota is as much as the hosting package you purchased foresees. If you have to exceed the quota we have allocated to you, we can freeze your account until your next quota is created, you can buy additional traffic, or switch to a hosting package with higher features. Unused traffic within the month cannot be transferred to the next month. For our customers using unlimited traffic hosting; their accounts will not be frozen or deleted due to traffic as long as they do not exceed their resource usage and comply with the terms in the contract of the package they purchased. In unlimited traffic web hosting packages, bandwidth is unlimited only for your site for which you purchased service. You cannot use traffic for other sites.

Money back guarantee

There is no money back guarantee within the scope of Server, SSL, Domain Name and License Services, Support Packages, Migration, Backup Services and all service renewals. 7-day money back guarantee does not cover these services. All reseller and shared hosting service packages provided by Hostixo.com are covered by the 7-day money back guarantee. Remember, this 7-day money back guarantee is only for users using shared or reseller packages and making annual payments. It does not cover additional costs such as server rental, domain name registration, administrative costs, package add-ons. There is no refund for services such as domain name registration and software licenses in initial purchases or renewals.

Uptime Guarantee

Our Shared Hosting and Reseller servers are monitored 24 hours a day by our teams, in case of any interruption in any of our servers, we guarantee to intervene as soon as possible. However, this period may extend in direct proportion to the workload of the data center where our servers are located and the problem that may occur on the server.

Reseller: Customer Responsibility

Reseller customers are responsible for supporting their own customers. Hostixo.com does not provide any support service to reseller customers' customers. If our reseller customer's customer contacts us for support, we will inform them about who and how they can get support service. Support requests involving security issues can only be made by the reseller customer. Also, reseller customers are responsible for the content and behavior of their customers under their own accounts. When Hostixo.com detects any situation contrary to the usage agreement, it considers the reseller customer as responsible.

Shared Hosting / VPS

Users using shared hosting cannot provide hosting services. If you want to provide hosting services, you must have a reseller account. VPS accounts are not backed up, you must manage your backups yourself.

Servers It is entirely the customer's responsibility to have a valid e-mail account and ensure the security of the root password. Hostixo.com does not perform any backup operations for servers, it is entirely the customer's responsibility to manage and create backup operations. If you wish, you can buy an additional hard disk for the backup system and manage your backups, this is the simplest solution we can suggest to you. If you need a second hard disk, you can contact us via destek@hostixo.com e-mail address. Managing your backups is entirely your responsibility.

Domain Agreement

1. PARTIES
 The following terms are agreed between HOSTİXO BİLİŞİM LİMİTED ŞİRKETİ operating at Ömer HalisDemir University Campus Technopark Building Floor: 2 No: 216 Niğde (hereinafter referred to as HOSTİXO.COM) and the real or legal person purchasing products and services through the HOSTİXO.COM internet site address under its control (hereinafter referred to as CUSTOMER).

2. START DATE AND DURATION OF THE AGREEMENT
2.1 Confirming this agreement electronically means that you have read the agreement and accepted and agreed to all the terms contained in the agreement.
2.2 All disputes that may arise between both parties will be resolved within the framework of the explanations detailed in the agreement. If the CUSTOMER violates the specified conditions, HOSTİXO.COM may seize the relevant accounts or suspend the services provided for a period or indefinitely.
2.3 This agreement comes into force between HOSTİXO.COM and the CUSTOMER upon the CUSTOMER's approval. This agreement covers the rules regarding domain registration and transfer that HOSTİXO.COM provides or will provide to the CUSTOMER, and general service conditions.

3. DEFINITIONS
3.1 CUSTOMER and HOSTİXO.COM accept that the CUSTOMER is the sole authority regarding the allocated domain.
3.2 If the domain service is purchased by a legal entity, the authorized signatory of the company is accepted as the authorized person for the domain.
3.4 The CUSTOMER accepts all rules determined or to be changed later by both HOSTİXO.COM and the Authorized Registration Operator. HOSTİXO.COM may need to make changes to this agreement when necessary to comply with the rules and policies determined by ICANN or organizations appointed as Registration Authority by ICANN. The CUSTOMER accepts that these changes can be made.
3.5 The service is not considered complete until the domain is registered. For domain names that cannot be registered, require documents, are reserved, or are premium, HOSTİXO.COM performs an unconditional refund and can cancel the order.

4. FEES
In case the services offered for sale by HOSTİXO.COM are requested by the CUSTOMER, the CUSTOMER accepts to pay for the service. Payment is made by the CUSTOMER using any of the payment methods determined by HOSTİXO.COM. The payment methods determined by HOSTİXO.COM are; payment by credit card online, bank transfer or EFT. Service fees may be determined in Turkish Lira or US Dollars. However, all payments are converted to Turkish Lira based on the current exchange rate during the order stages and payment is made in Turkish Lira. When domain registration service is purchased, if HOSTİXO.COM cannot collect all or part of the fee for the service provided or if it refunds the payment as a result of an objection made later even if the payment has been collected, HOSTİXO.COM may apply to all kinds of legal sanctions for the collection of the payment. In addition, when necessary, it can suspend the CUSTOMER's services temporarily or permanently. If the service is performed by a different person or institution and this person or institution claims to be the original owner of the service, the domain is transferred to the person making the payment. However, the contents uploaded by the CUSTOMER are not transferred. Only the service transfer is performed.

5. DOMAIN REGISTRATION AND RENEWALS
Domain registrations are registered for a period between 1-5 years according to the CUSTOMER's preference. The CUSTOMER can extend the duration if desired. Extension is realized by the CUSTOMER placing an order and making payment via the control panel. HOSTİXO.COM is not obliged to perform or follow up the domain renewal process. HOSTİXO.COM sends warning emails to the email address notified by the CUSTOMER during registration. However, HOSTİXO.COM has no obligation if these emails are not noticed or reached by the CUSTOMER. The CUSTOMER is obliged to follow the domain expiration date.

In .TR domain names, TRABIS (“.tr” extension internet domain name system) is responsible, but HOSTİXO.COM cannot be held responsible for problems that may occur due to systemic problems. HOSTİXO.COM cannot be held responsible for negativities that may occur due to TRABIS registering or not registering the domain name.

If the domain renewal fee cannot be collected from the CUSTOMER for any reason, the domain registered by HOSTİXO.COM will be out of use at the end of the period. The domain that is out of use can be renewed and become active by extending the period if the CUSTOMER requests it within 15 days and covers the costs to be incurred. However, after 15 days, the domain enters the Redemption Period process. If the CUSTOMER wants to buy the domain within this process, the costs requested by ICANN are added and the costs are collected. At the end of the Redemption Period, the domain enters the cancellation process. No renewal process can be done in any way during this process. At the end of the process, the domain will become available for purchase by anyone again.

6. AGREEMENT CONDITION; CHANGES

This agreement is valid as long as the CUSTOMER performs the domain registration process through HOSTİXO.COM. Due to ICANN rules, the domain cannot be transferred to another company for 60 days from the domain registration and renewal process. HOSTİXO.COM may make changes to this agreement from time to time in accordance with both laws and international domain rules. The CUSTOMER is deemed to have accepted these changes and updates that may be made. If the CUSTOMER wants to terminate this agreement unilaterally, he/she is deemed to have accepted that he/she will not receive any refund.

Domain name transactions are carried out within the framework of procedures determined by ICANN (Internet Corporation for Assigned Names and Numbers), which is organized internationally, and TRABIS ("“.tr”" extension internet domain name system). These procedures are rules determined by the relevant authority, are valid worldwide, cannot be changed and are binding for all domain name extensions.

7. CURRENT CUSTOMER INFORMATION; USE OF INFORMATION AND EXPIRATION

The CUSTOMER is obliged to keep the information provided as part of the services received accurate and up-to-date. In case of any change in any information, he/she must make the changes on the HOSTİXO.COM side. Regardless of the reason, if the information given by the CUSTOMER to HOSTİXO.COM is not correct, the agreement is deemed to be violated. In addition, in suspicious cases, HOSTİXO.COM has the right to request up-to-date information from the CUSTOMER. If this information is not provided, HOSTİXO.COM has the authority to stop and cancel the services provided. The CUSTOMER accepts that the contact information given during domain registration will be seen on the internet within the framework of the rules of the registrars. The CUSTOMER cannot hold HOSTİXO.COM responsible for this information seen by everyone on the internet.

For each domain registered by the CUSTOMER, the information detailed below is included in the whois services for everyone to see in accordance with international domain policies. It is deemed accepted by the CUSTOMER that 3rd parties on the internet can access this information as a result of inquiries and this information can be used commercially.

8. DISPUTE RESOLUTION POLICY
The CUSTOMER is deemed to have accepted the "Dispute Resolution Policy" organized by HOSTİXO.COM within the framework of international domain rules. HOSTİXO.COM may change these rules when necessary. The CUSTOMER accepts that it is necessary to read the agreements on the HOSTİXO.COM site at regular intervals to examine the changes made in the resolution rules while receiving service. If the CUSTOMER wants to cancel the domain registration due to these changes, no refund can be made.

9. DOMAIN TRANSFER PROCEDURES
The CUSTOMER can transfer any domain to another person through the HOSTİXO.COM site or CUSTOMER authorized person. After the transfer process is realized, the domain cannot be taken back or its operation cannot be interfered with. The CUSTOMER performs the transfer process after researching all risks and being sure before the transfer. HOSTİXO.COM cannot be held responsible for disputes experienced after the transfer. The domain can be transferred to another domain registrar only through the transfer code. After the domain is transferred to another company, HOSTİXO.COM has no responsibility on the relevant domain.

10. SUSPENSION OF SERVICES; BREACH OF CONTRACT
The CUSTOMER accepts all rules determined by HOSTİXO.COM or the authorized registrar. In case of non-compliance with the rules specified in the agreements, HOSTİXO.COM has the right to stop, suspend or cancel the specific service.

11. RESTRICTION OF SERVICES; RIGHT OF REFUSAL
Any domain sold by HOSTİXO.COM cannot be cancelled in any way after the sale is realized. No changes can be made to the domain name. No refund can be made in any way.

The CUSTOMER receiving the domain service accepts and undertakes not to use or let others use it for the purposes specified below.

12. UNSOLICITED E-MAIL SENDING (SPAM)
12.1 Performing high volume or repetitive transactions on services provided by HOSTİXO.COM (such as domain query)
12.2 Uses such as mail bombing destination address, packet corruption, internet packet flooding.
12.3 Making illegal entry to servers, damaging or entering by taking advantage of security vulnerabilities.
12.4 Attempts constituting legal crimes such as slander, harm, threat, harassment, etc. against any person or institution.
12.5 Crimes defined in Law No. 5651.
12.6 Terror and hate crimes, child pornography content or links provided to these contents.
12.7 Attempts to impersonate a different person.
12.8 Contents contrary to general morality

HOSTİXO.COM can take all kinds of measures such as stopping, cancelling regarding the domain service in such cases. No refund is made for the domain fee due to breach of contract.

Hosting Service Agreement

1. PARTIES 
The following terms are agreed between HOSTİXO BİLİŞİM LİMİTED ŞİRKETİ . operating at Ömer HalisDemir University Campus Technopark Building Floor : 2 No : 216 Niğde (hereinafter referred to as HOSTİXO.COM) and the real or legal person purchasing products and services through the HOSTİXO.COM internet site address under its control (hereinafter referred to as CUSTOMER).

2. START DATE AND DURATION OF THE AGREEMENT
2.1 Confirming this agreement electronically means that you have read the agreement and accepted and agreed to all the terms contained in the agreement.
2.2 All disputes that may arise between both parties will be resolved within the framework of the explanations detailed in the agreement. If the CUSTOMER violates the specified conditions, HOSTİXO.COM may seize the relevant accounts or suspend the services provided for a period or indefinitely.
2.3 This agreement comes into force between HOSTİXO.COM and the CUSTOMER upon the CUSTOMER's approval. This agreement covers the rules regarding hosting services that HOSTİXO.COM provides or will provide to the CUSTOMER, and general service conditions.

3. DEFINITIONS
3.1 The service provided to the CUSTOMER by HOSTİXO.COM is the publication of web sites or databases on servers whose infrastructure is provided by HOSTİXO.COM. The CUSTOMER can purchase Reseller Hosting, Web Hosting or Database services independently of each other or together. When the CUSTOMER purchases these services, he/she is deemed to have accepted all the terms in this agreement.
3.2 HOSTİXO.COM is obliged to provide the relevant service in the best possible way depending on the articles of the agreement. The CUSTOMER accepts that there may be problems in accessing the services in some cases. Problems that may cause service disruption are given below.

• Force majeure (natural disasters, war, etc.)
• Hardware failures
• Interruptions during maintenance
• Interruptions on internet lines, interruptions during malicious attacks

3.3 The CUSTOMER accepts that problems may occur regarding the services provided by HOSTİXO.COM.
3.4 HOSTİXO.COM will show maximum effort to ensure continuity in the services provided to the CUSTOMER.
3.5 HOSTİXO.COM can stop and examine the services it provides.
3.6 SSL Certificates are used with a specific domain and service (products such as hosting, server, e-mail). The SSL service sold by HOSTİXO.COM or a different company works only depending on a specific domain and service and is specially designed. It may not be possible to move SSL to another company or service.
The CUSTOMER must keep and back up the private key (Private KEY) of the SSL certificate working depending on a web site on HOSTİXO.COM servers on his/her own side. The CUSTOMER cannot request the private key from HOSTİXO.COM in the process of moving to another server. This process is done with the private key backed up by the customer. HOSTİXO.COM cannot be held responsible for technical problems that may occur in case of moving the SSL certificate.
3.7 Within the scope of Reseller Hosting service, HOSTİXO.COM gives the CUSTOMER the right to sell to 3rd parties.
The CUSTOMER is responsible for the support requests requested by 3rd parties belonging to the services provided under the Reseller Hosting service.
HOSTİXO.COM only provides technical support service to the CUSTOMER. The CUSTOMER is responsible for the content within the reseller hosting package. In case of any legal investigation, HOSTİXO.COM gives the requested contact information or log records to judicial authorities or law enforcement officers.

3.8 Domain names in the domain name gift campaign given in some packages are defined during the order. They are not given later. Although the gift domain covers the first year of the service period, the renewal price in the price list is applied in the renewal process. In case of return/cancellation in our packages with free domain names, the refund is made by deducting the domain name amount.

3.9 Free Migration process is carried out according to the density and data guarantee is not offered. Hostixo is only obliged to transfer site data from the old service provider to its own servers and the responsibility for not working due to possible problems on the site belongs to the customer.  Additional service fee may be requested in high-size moving operations.

3.10 Unlimited definitions have been created in order not to experience access problems in instant densities and usages of 5GB and above are subject to controls. Removal of content may be requested by warning when deemed necessary.

3.10 Email quotas are limited within the scope of package limits on our website in IMAP format. Fee may be requested for additional quota.

3.11 In order to provide Free SSL certificate, the domain name must be directed to our company NS address. 

3.12 Our company does not accept responsibility if Free SSL is not received due to domain name or a different reason.  Hostixo does not offer Free SSL guarantee.

3.13 Hostixo does not accept responsibility in services offered free of charge.

3.14  Data guarantee is not offered in the optionally free return from backup service, but free return can be requested once a month. Additional service fee may be requested for more requests.

3.15  Optionally free backup service does not cover sites hosting over 5GB of data.

3.16  Optionally free SSL certificate is automatically renewed in 3-month periods. Renewal guarantee is not offered. Follow-up and control is the customer's responsibility.

3.17  In Reseller packages, hosting sites that consume high resources such as high disk usage that do not broadcast over the server is not allowed.

3.18  In Reseller packages, if software for test purposes or demo purposes consume high resources, removal may be requested by informing the user.

4. CLIENT OBLIGATIONS

4.1. The CUSTOMER cannot engage in behaviors and shares intended to damage the commercial reputation and dignity of HOSTİXO.COM. In case these types of attempts are detected, HOSTİXO.COM has the right to terminate the agreement.
4.2. By accepting this agreement, the CUSTOMER agrees not to publish contents contrary to laws, regulations, bylaws, general morality and manners. The CUSTOMER is responsible for the contents belonging to himself/herself or his/her sub-customers. In contrary cases, HOSTİXO.COM may suspend services or completely delete them from its systems. No refund is made in cases contrary to such contract provisions.

Contents contrary to the agreement in Hosting and Reseller Hosting services are;

• Crontab (scheduled task) usage more frequent than 15 Min
• Toplist sites
• IRC scripts, bots
• Proxy scripts/anonymizers
• Pirated software/warez
• Image Hosting Scripts (like Photobucket or Tinypic)
• AutoSurf/PTC/PTS/PPC sites
• IP Scanners
• Bruteforce Programs/Scripts/Applications
• Mail Bombers/Spam Scripts
• Banner-Ad services (commercial banner ad cycle)
• Dump file/Mirror scripts (like rapidshare)
• Commercial Audio Broadcasting (more than one or two broadcasts)
• Escrow account/Bank Bonds
• Investment sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
• Sale of substances subject to permission without proving the existence of necessary permission(s) in advance
• Programs of banks determining the market
• Lottery/gambling sites
• Sites making traffic artificially
• MUDs/RPGs/PBBGs
• Hacker-focused sites/archives/programs
• Sites promoting illegal activities
• Forums or internet sites distributing warez/pirated/illegal content or linking to them
• Fraud Sites (including those counted in aa419.org and escrow-fraud.com)

• Mailer Pro
• All kinds of broadcasts of Live Sports Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWFi, Lig TV, Super Lig, PTT 1. Lig, Bein Sports, LaLiga etc.)

It is forbidden to engage in activities known as illegal and criminal even if they are not specified in the written lists. Otherwise, HOSTİXO.COM reserves the right to terminate the agreement.

4.3. Resource Usage
CUSTOMER;
4.3.1 100% or more of the system resources used in service procurement cannot be used for 180 seconds or more. Sites making constant 100% usage are limited with a lower level processor limit.
4.3.2 Limited to 100,000 (one hundred thousand) for limited packages and 200 thousand INODE (total number of files and folders) for Unlimited Hosting packages.
4.3.3 Content unrelated to the web site, other than web site content, cannot be kept.
4.3.4 Personal contents cannot be stored under picture, video, music gallery.
4.3.5 It cannot be used for archival purposes for any kind of content.
4.3.6 Files intended for sharing cannot be hosted (files with zip, .wpress, tar.gz, rar etc. compressed extensions)
4.3.7 Database service cannot be used as remote server.
4.3.8 Hourly email sending is limited to 250 pieces.

4.3.9 Files intended for backup cannot be hosted (files with zip, .wpress, tar.gz, rar etc. compressed extensions)

4.4 Bandwidth Usage
Even if the bandwidth deemed usable by the CUSTOMER monthly is unlimited, there are limits owned by the server and infrastructure. In case these limits are reached, access problems may be experienced.
4.5 HOSTİXO.COM shows necessary effort to publish all data of the CUSTOMER securely. However, it cannot be held responsible as a result of problems that may arise. Backing up data is the CUSTOMER's own responsibility.
The CUSTOMER is obliged to protect the password belonging to the accounts and the email address where passwords are sent. HOSTİXO.COM cannot be held responsible for damages that may occur as a result of passwords passing into the hands of other people.

5. PAYMENT
5.1 The CUSTOMER is obliged to make payments regarding the services purchased from HOSTİXO.COM always in advance. In case payment is not made, HOSTİXO.COM has the right to terminate the service.
5.2 In case the CUSTOMER makes payment to bank accounts, he/she must enter the order number in the description section. Otherwise, it cannot be determined by HOSTİXO.COM which service the payment made belongs to. HOSTİXO.COM cannot be held responsible for damages that may occur in this case.
5.3 In Hosting and Reseller hosting services, the service is stopped if 2 days pass from the end of the period. It is permanently deleted from systems after 7 days pass.

5.4 The CUSTOMER cannot hold our company responsible for data after the deletion process.

6. ADDITIONAL FEE
6.1 Additional service fee may be requested when our team is asked to perform transactions under the CUSTOMER's own responsibility regarding the services purchased from HOSTİXO.COM.

6.2 If the CUSTOMER has not renewed within the specified period and his/her account has been completely deleted, a return from backup fee may be requested if he/she requests a backup from our company.

7. TERMINATION OF THE AGREEMENT
HOSTİXO.COM can change the articles of the agreement whenever it wants. The CUSTOMER is deemed to have accepted that such changes can be made as long as he/she continues to receive service.
If the CUSTOMER acts contrary to the rules in HOSTİXO.COM agreements, HOSTİXO.COM can stop the services provided to the CUSTOMER without notice. In this case, no refund is made.

Server Service Agreement

1. PARTIES
The following terms are agreed between HOSTİXO BİLİŞİM LİMİTED ŞİRKETİ . operating at Ömer HalisDemir University Campus Technopark Building Floor : 2 No : 216 Niğde (hereinafter referred to as HOSTİXO.COM) and the real or legal person purchasing products and services through the HOSTİXO.COM internet site address under its control (hereinafter referred to as CUSTOMER).

2. START DATE AND DURATION OF THE AGREEMENT
2.1 Confirming this agreement electronically means that you have read the agreement and accepted and agreed to all the terms contained in the agreement.
2.2 All disputes that may arise between both parties will be resolved within the framework of the explanations detailed in the agreement. If the CUSTOMER violates the specified conditions, HOSTİXO.COM may seize the relevant accounts or suspend the services provided for a period or indefinitely.
2.3 This agreement comes into force between HOSTİXO.COM and the CUSTOMER upon the CUSTOMER's approval. This agreement covers the rules regarding services that HOSTİXO.COM provides or will provide to the CUSTOMER, and general service conditions.

3. SERVICE DETAIL
The list of services that HOSTİXO.COM will provide to the CUSTOMER within the scope of this agreement is given below

• Rental of Physical Server belonging to HOSTİXO.COM (Dedicated or Rental Server)
• VPS , VDS Server or Cloud Server (Virtual servers serving over HOSTİXO.COM servers)
• Server Hosting Service (Co-location)

4. SERVICE OBLIGATIONS
4.1 After the customer makes the payment, the service is opened for use and the information is sent to the customer. Service activation can be online or may require a 24-48 hour installation process in cases requiring special installation.
4.2 HOSTİXO.COM cannot be held responsible for access problems arising from problems such as interruption, slowness occurring in internet lines developing outside the control of HOSTİXO.COM.
4.3 HOSTİXO.COM cannot be held responsible for problems that may occur in software and hardware used on the server after HOSTİXO.COM opens the service.
4.4 Backup responsibility on servers belongs to the CUSTOMER. HOSTİXO.COM cannot be held responsible for any data loss for whatever reason.
4.5 The CUSTOMER is responsible for all software licenses unless it is notified that they are covered by HOSTİXO.COM. The CUSTOMER is responsible for compensating all kinds of damages to be given to 3rd parties or institutions.
4.6 The CUSTOMER is responsible for the content included in the servers belonging to the CUSTOMER. HOSTİXO.COM may stop the service if deemed necessary as a result of all kinds of requests and notifications made by Courts, Prosecutor's Office, BTK or law enforcement officers.
4.7 In rental server and VDS/VPS services, HOSTİXO.COM is responsible for hardware problems. Part replacement will be made by HOSTİXO.COM as soon as possible depending on part supply.
4.8 Server support will be given within the framework of server support packages. Server management is the responsibility of the CUSTOMER as standard unless otherwise stated.
HOSTİXO.COM delivers the server in working condition, after the management passes to the CUSTOMER, the CUSTOMER will be responsible for problems caused by user-oriented errors such as wrong configuration, file deletion, file changing, harmful content, harmful software. HOSTİXO.COM fixes the problem for a fee over the server support price tariff or can make a new installation again for a fee.
4.9 Even if the server belongs to himself/herself, the CUSTOMER cannot send unauthorized e-mail (SPAM), commit Fraud (Phishing) in any way. Even if it is done outside the control of the CUSTOMER, HOSTİXO.COM has the right to suspend the service without notice when necessary.
4.10 Contents that cannot be hosted in server services are given below

• Pirated Software/Warez
• IP Scanners
• Bruteforce Programs/Scripts/Applications
• Mail Bombers/spam scripts
• Escrow account

• Fraud Sites (including those counted in aa419.org and escrow-fraud.com)
• Mailer Pro
• All kinds of broadcasts of Live Sports Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF etc.)
• Game Servers

5. FEE and COLLECTION
5.1 HOSTİXO.COM notifies the customer via e-mail of the fees to be collected for the service.
5.2 HOSTİXO.COM has the authority to collect the payment upon acceptance of the service by the CUSTOMER.
5.3 HOSTİXO.COM may suspend the service in case renewal payments are not made on time. HOSTİXO.COM is not responsible for damages that will occur due to the suspension of the service.
5.4 In case service renewal is not made, the service is permanently deleted from systems on the 7th day after the service end date.
5.5  The customer accepts that there is no refund in server services.

5.6 Free services are given because the customer commits to the service and will use the service for the period he/she purchased. If the service is cancelled before this period, the service offered free of charge will be charged and the remaining amount will be refunded. 

6. TERMINATION OF THE AGREEMENT

6.1 Changes that will occur in time in this agreement approved by the CUSTOMER during his/her online application will be notified to the CUSTOMER by publishing on the website and/or via e-mail.
By continuing to use HOSTİXO.COM services, the CUSTOMER will be deemed to have accepted the changing agreement terms.
6.2 In case payments are not made or delayed in any way, HOSTİXO.COM reserves the right to terminate the agreement.
6.3 In case the rules specified in the agreement are not complied with, HOSTİXO.COM terminates the agreement. No refund is made.

License Services Agreement

1. PARTIES
The following terms are agreed between HOSTİXO BİLİŞİM LİMİTED ŞİRKETİ . operating at Ömer HalisDemir University Campus Technopark Building Floor : 2 No : 216 Niğde (hereinafter referred to as HOSTİXO.COM) and the real or legal person purchasing license service through the HOSTİXO.COM internet site address under its control (hereinafter referred to as CUSTOMER).

2. START DATE AND DURATION OF THE AGREEMENT
2.1 Confirming this agreement electronically means that you have read the agreement and accepted and agreed to all the terms contained in the agreement.
2.2 All disputes that may arise between both parties will be resolved within the framework of the explanations detailed in the agreement. If the CUSTOMER violates the specified conditions, HOSTİXO.COM may seize the relevant accounts or suspend the services provided for a period or indefinitely.
2.3 This agreement comes into force between HOSTİXO.COM and the CUSTOMER upon the CUSTOMER's approval. This agreement covers the rules regarding licensing services that HOSTİXO.COM provides or will provide to the CUSTOMER, and general service conditions.

3. SERVICE DETAIL
The list of services that HOSTİXO.COM will provide to the CUSTOMER within the scope of this agreement is given below

• It covers cPanel License, Litespeed License, Directadmin License, Cloudlinux license, Softaculous License and all other license services purchased from HOSTİXO.COM company.
• It covers license services we provide to our customers who receive server rental service by HOSTİXO.COM company.
• It covers license services we provide to our customers who receive server hosting service by HOSTİXO.COM company.

4. SERVICE OBLIGATIONS
4.1 After the customer completes the payment process, the license service is opened for use and activation content is sent to the customer.
4.2 The license service will be defined for a single IP address or a single server.
4.3 There is absolutely no refund in license services.
4.4 Online activation is performed in license services, and HOSTİXO.COM cannot be held responsible for problems originating from the customer server.
4.5 License services only cover the license service, and do not cover software installation.
4.6 License services do not include support for issues regarding software usage or problems that may occur.
4.7 Management of the server for which license service is purchased is the user's responsibility and HOSTİXO.COM cannot be held responsible for server management.
4.8 Hostixo states that it is an intermediary company and HOSTİXO.COM cannot be held responsible for problems originating from software provider companies.

5. FEE and COLLECTION
5.1 HOSTİXO.COM notifies the customer via e-mail of the fees to be collected for the service.
5.2 HOSTİXO.COM has the authority to collect the payment upon acceptance of the service by the CUSTOMER.
5.3 HOSTİXO.COM may suspend the service in case renewal payments are not made on time. HOSTİXO.COM is not responsible for damages that will occur due to the suspension of the service.
5.4 HOSTİXO.COM issues invoices regarding the services provided. Invoices can be downloaded via the CUSTOMER panel.
5.5 In license services, licenses whose invoice date has passed by 1 day are closed and 1 month license fee must be paid for them to be active again.

5.6 Reactivation fees may arise due to license renewal by the software company, HOSTİXO.COM is not responsible for these fees.

6. TERMINATION OF THE AGREEMENT
6.1 Changes that will occur in time in this agreement approved by the CUSTOMER during his/her online application will be notified to the CUSTOMER by publishing on the website and/or via e-mail.
By continuing to use HOSTİXO.COM services, the CUSTOMER will be deemed to have accepted the changing agreement terms.
6.2 In case payments are not made or delayed in any way, HOSTİXO.COM reserves the right to terminate the agreement.
6.3 In case the rules specified in the agreement are not complied with, HOSTİXO.COM terminates the agreement. No refund is made.

SSL Certificate Agreement

1. PARTIES
The following terms are agreed between HOSTİXO BİLİŞİM LİMİTED ŞİRKETİ . operating at Ömer HalisDemir University Campus Technopark Building Floor : 2 No : 216 Niğde (hereinafter referred to as HOSTİXO.COM) and the real or legal person purchasing SSL service through the HOSTİXO.COM internet site address under its control (hereinafter referred to as CUSTOMER).

2. START DATE AND DURATION OF THE AGREEMENT
2.1 Confirming this agreement electronically means that you have read the agreement and accepted and agreed to all the terms contained in the agreement.
2.2 All disputes that may arise between both parties will be resolved within the framework of the explanations detailed in the agreement. If the CUSTOMER violates the specified conditions, HOSTİXO.COM may seize the relevant accounts or suspend the services provided for a period or indefinitely.
2.3 This agreement comes into force between HOSTİXO.COM and the CUSTOMER upon the CUSTOMER's approval. This agreement covers the rules regarding SSL Certificate services that HOSTİXO.COM provides or will provide to the CUSTOMER, and general service conditions.

3. SERVICE DETAIL
It covers the paid or free SSL certificate service that HOSTİXO.COM provides to the CUSTOMER within the scope of this agreement.

4. SERVICE OBLIGATIONS
4.1 It is not allowed to use any SSL certificates on web sites and digital environments where products and services prohibited by law are sold.
4.2 Hosting Free SSL Certificates are provided by automation in 3-month periods, and HOSTİXO.COM cannot be held responsible for problems that may occur.
4.3 Free installation support offered in Paid SSL certificates is one-time, and repetition will be paid.
4.4 Free installation support offered in Paid SSL certificates is carried out on cPanel and Plesk. It is not offered paid or free to other panels.
4.5 HOSTİXO.COM cannot be held responsible for problems originating from the opposite server in the free installation support offered in Paid SSL certificates.
4.6 Validation method is presented to the customer in Paid SSL certificates, and its realization is the customer's responsibility.
4.7 Opening the web site as https, that is with SSL, is the customer's responsibility. HOSTİXO.COM does not offer support in this regard.
4.8 Hostixo states that it is an intermediary of the SSL Certificate brand and will provide technical support for the guarantee offered by the SSL brand to its customer against any security breach that may occur during the use of SSL certificate. However, whatever happens, HOSTİXO.COM cannot be held responsible for problems originating from SSL Certificate or other factors.

5. FEE and COLLECTION
5.1 HOSTİXO.COM notifies the customer via e-mail of the fees to be collected for the service.
5.2 HOSTİXO.COM has the authority to collect the payment upon acceptance of the service by the CUSTOMER.
5.3 HOSTİXO.COM may suspend the service in case renewal payments are not made on time. HOSTİXO.COM is not responsible for damages that will occur due to the suspension of the service.
5.4 HOSTİXO.COM issues invoices regarding the services provided. Invoices can be downloaded via the CUSTOMER panel.
5.5  Paid SSL Certificate services are stopped 1 day after the invoice date passed, and are deleted with the backup on the 3rd day. 
5.6 HOSTİXO.COM cannot be held responsible for data losses that will occur in collection-related situations. 

6. TERMINATION OF THE AGREEMENT
6.1 Changes that will occur in time in this agreement approved by the CUSTOMER during his/her online application will be notified to the CUSTOMER by publishing on the website and/or via e-mail.
By continuing to use HOSTİXO.COM services, the CUSTOMER will be deemed to have accepted the changing agreement terms.
6.2 In case payments are not made or delayed in any way, HOSTİXO.COM reserves the right to terminate the agreement.
6.3 In case the rules specified in the agreement are not complied with, HOSTİXO.COM terminates the agreement. No refund is made.

Backup Agreement

1. PARTIES

2.1 Confirming this agreement electronically means that you have read the agreement and accepted and agreed to all the terms contained in the agreement.

3. SERVICE DETAIL
It covers the paid or free backup service that HOSTİXO.COM provides to the CUSTOMER within the scope of this agreement.

4. SERVICE OBLIGATIONS
4.1 Weekly backup service in hosting services is offered free of charge as a gift within the scope of the package purchased from Hostixo, and HOSTİXO.COM cannot be held responsible for disruptions that may occur.
4.2 Hosting services are backed up to a different backup server at certain periods, but customers are primarily responsible for taking their own backups.
4.3 In the backup service offered paid or free in hosting services, the restoration from backup process must be done by the customer via the control panel.
4.4 HOSTİXO.COM cannot be held responsible for problems originating from Jetbackup and similar plugins offered via the control panel in hosting services.
4.5 Free backup service is for sites not exceeding 5GB size, and HOSTİXO.COM cannot be held responsible for problems that may occur.
4.6 Backup service offered in server services is taken due to possible system failure and backups are shared based on goodwill. 
4.7 Backup service offered in server services depends on automation, and HOSTİXO.COM cannot be held responsible for problems originating from automation.
4.8 Regardless of the service, backup responsibility is primarily the customer's responsibility. HOSTİXO.COM cannot be held responsible for data losses that will occur.
4.9 Free backup service is not offered in physical server or server hosting services, and HOSTİXO.COM cannot be held responsible for problems that will occur.

5.6 HOSTİXO.COM cannot be held responsible for data losses that will occur in collection-related situations.
5.7 Hostixo is not obliged to share free backup in packages whose service period has expired. In case a backup is found, it can perform backup uploading by making package renewal or additional pricing.

6. TERMINATION OF THE AGREEMENT
